Terms and Conditions

Section 1 - Introduction

This website, 44hours.com (“the Site”), is operated by 44HOURS. By accessing or using the Site and its services, users agree to abide by the terms and conditions set forth herein, as well as any additional policies or operating rules posted on the Site.

These Terms apply to all users of the Site, including browsers, vendors, customers, merchants and contributors of content.

Section 2 - Orders & Payment

Orders placed through the Site are subject to acceptance and availability. Accepted payment methods include credit and debit cards, PayPal and other payment services provided by Shopify.

All prices are listed in euros (€), and users are responsible for any applicable taxes, duties and fees.

44HOURS reserves the right to refuse or cancel any order at its discretion, particularly in cases of suspected fraud, incorrect pricing, stock errors or violations of these Terms.

Section 3 - Accuracy, Completeness and Timeliness of Information

The information provided on the Site, including product descriptions, pricing, promotions and availability, is intended for general information purposes only.

Although efforts are made to ensure accuracy, 44HOURS does not guarantee the correctness, completeness or timeliness of all content at all times.

Users should not rely solely on the information presented on the Site to make purchasing decisions. Historical information is provided for reference and may not be current.

Section 4 - Prices and Service Modifications

Prices for products and services are subject to change at any time without notice.

44HOURS reserves the right to modify or discontinue any product or service at its sole discretion.

In the event of any price changes or service modifications, 44HOURS shall not be liable to users or third parties for any damages or losses.

Section 5 - Submissions and User Content

By submitting creative ideas, suggestions, proposals or other materials (“comments”), whether requested or unsolicited, users grant 44HOURS the right to edit, copy, publish and use these comments in any medium, without restriction or compensation.

44HOURS is under no obligation to maintain the confidentiality of such submissions, respond to them or provide any form of payment.

44HOURS reserves the right, but is not obligated, to monitor, edit or remove content that violates these Terms or is deemed unlawful, offensive or otherwise inappropriate.

Users are solely responsible for ensuring their submissions do not infringe on the rights of others or contain harmful content.

Section 6 - Shipping & Delivery

Shipping fees and estimated delivery times are displayed at checkout.

Delivery times are estimates and may vary based on location, shipping method, courier service, peak periods, holidays or unforeseen delays.

44HOURS is not responsible for delays caused by third-party couriers or incorrect shipping information provided by the customer.

Once an order has been dispatched, delivery is handled by the courier.

Section 7 - Cancellations

Orders can be cancelled as long as they have not been shipped.

If you would like to cancel your order, please contact us as soon as possible at contact@44hours.com with your order number.

Pre-order items can also be cancelled as long as they have not been shipped.

Refund Process

If your cancellation request is approved before the order has been shipped, the refund will be processed to the original payment method. Please note that your payment provider may need additional time to complete the refund.

If your order has already been shipped, cancellation is no longer possible. In that case, you may register a return after delivery according to our Return Policy.

If your order has already been processed, fulfilled or dispatched, the standard return conditions apply.

Section 8 - Returns, Refunds and Exchanges

Returns are accepted within 14 days of delivery, provided that the item meets our return conditions.

Items must be returned in the same condition as received:

  • Unworn, unused, unwashed and undamaged

  • Free from perfume, body odour, deodorant, make-up, stains, marks or any other signs of wear

  • With all original tags attached

  • Packed in the original box or original packaging

All returned items are inspected upon arrival.

If a return does not meet these conditions or cannot be resold as new, 44HOURS reserves the right to refuse the return, apply a reduction in refund value or send the item back to the customer.

Return labels are valid for 10 days. If your return label expires, please contact us before shipping your return.

The cost of return shipping is the responsibility of the customer unless otherwise specified. 44HOURS is not responsible for return packages lost or undelivered in transit.

We currently do not offer exchanges. If you need a different size, please place a new order and return the original item according to our Return Policy.

Section 9 - Limitation of Liability

44HOURS does not guarantee that the use of its services will be uninterrupted, timely, secure or error-free.

The results obtained from using the services are not guaranteed to be accurate or reliable.

Users acknowledge that the service may be suspended or discontinued at any time without notice.

All services, products and content provided on the Site are offered on an “as is” and “as available” basis, without warranties or conditions of any kind, either express or implied.

This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.

44HOURS, including its officers, directors, employees and affiliates, will not be held liable for any direct, indirect, incidental, punitive, special or consequential damages arising from the use of the service, products or any errors or omissions on the Site.

This includes, but is not limited to, damages related to lost profits, revenue, data or any similar losses.

Section 10 - Indemnification

Users agree to indemnify, defend and hold harmless 44HOURS, its affiliates, partners, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claims or demands, including legal fees, arising from a breach of these Terms, a violation of any laws or an infringement of third-party rights.

Section 11 - Prohibited Uses

Users are prohibited from using the Site or its content for the following purposes:

  • Engaging in unlawful activities or soliciting others to engage in unlawful acts

  • Violating local, national or international laws and regulations

  • Infringing upon intellectual property rights

  • Harassing, abusing or discriminating against others based on gender, race, ethnicity, religion, age, disability or other protected characteristics

  • Submitting false or misleading information

  • Uploading harmful content, such as viruses or malware

  • Collecting or tracking the personal information of others without consent

  • Using the Site for any immoral or obscene purposes

44HOURS reserves the right to terminate access to the Site for users who violate any of these prohibited uses.

Section 12 - Errors, Inaccuracies and Omissions

Occasionally, the Site may contain typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions or availability.

44HOURS reserves the right to correct these errors, update information or cancel orders if any information on the Site is inaccurate, even after an order has been placed.

44HOURS is under no obligation to update or correct information unless required by law.

Section 13 - Severability

If any provision of these Terms is deemed unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law.

The unenforceable portion shall be severed from these Terms, and the remaining provisions shall remain valid and enforceable.

Section 14 - Termination

These Terms shall remain in effect unless terminated by either party.

Users may terminate this agreement at any time by ceasing to use the Site and notifying 44HOURS.

44HOURS reserves the right to terminate the agreement without notice if it is suspected that a user has violated any of these Terms.

Any obligations or liabilities incurred prior to the termination date shall survive the termination.

Section 15 - Entire Agreement

These Terms, along with any policies or rules posted on the Site, constitute the entire agreement between the user and 44HOURS and supersede any prior agreements, communications or proposals, whether oral or written.

Any failure by 44HOURS to enforce a right or provision shall not be considered a waiver of that right or provision.

Any ambiguities in interpreting these Terms shall not be construed against the drafting party.

Section 16 - Governing Law

These Terms and any separate agreements between users and 44HOURS are governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles.

Section 17 - Changes to Terms

44HOURS reserves the right to update, modify or replace any part of these Terms by posting the changes on the Site.

Users are responsible for reviewing the Site periodically for updates.

Continued use of the Site after changes have been posted constitutes acceptance of those changes.

Section 18 - Coupon Code Usage During Sales

To maintain the integrity of our brand and ensure fair pricing for all customers, the following rules apply to the use of coupon codes or discount codes on our website.

Coupon codes or discount codes cannot be applied to items that are already discounted during a sale event on the website. This ensures consistency and fairness in our promotional pricing.

Discounts from different sources, including sales, promotional offers and coupon codes, cannot be combined. Only the highest applicable discount will be honoured.

These measures are in place to uphold the value and exclusivity of our products and to protect the interests of all customers, ensuring a fair and transparent shopping experience.

Our system is designed to automatically prevent the application of coupon codes to sale items.

If a technical issue occurs and a discount is inadvertently applied, 44HOURS reserves the right to cancel the order or adjust the total to reflect the correct pricing.

Any exceptions to this rule will be clearly stated in the terms of the specific promotional event.

By using a coupon code or participating in a sale, you agree to these Terms and Conditions.
